Application Filing:

After receiving your confirmation to proceed, we will file your application with the USPTO. Upon filing, we will provide you with a serial number assigned to your application by the USPTO, the filing date, and a filing receipt for your records.

  • Most likely- no. During the trademark review process, the USPTO will refuse your trademark if there is a likelihood of confusion with an existing trademark application or registration.

    However, it is possible to still register your mark if it is used for different goods or services because there will be no consumer confusion. For example, Dove soap and Dove chocolate are both registered because they operate in entirely different markets.

  • If everything runs smoothly, the process takes a year. The trademark processing wait time for an examiner to review your mark is eight months.

    The examiner working for the USPTO will review your application and either send an office action with questions or concerns or approve your trademark for publication. If your trademark is published and there are no objections by the public within 30 days, your trademark will be officially registered.

    If you have the intent to use your mark in commerce the trademark takes longer to register because you have to prove that you are using your mark in commerce through a Statement of Use before you are able to receive a registration.

  • The government filing fees for a TEAS Plus application are $250 per class of goods or services. The government filing fees for a TEAS Standard application are $350 per class of goods or services.

    If your application has an intent to use filing basis (you are not currently using your mark in commerce) there is an extra government fee of$100 to file a Statement of Use further along in the application process to prove use in commerce.

  • A trademark can “outlive” you and me. Trademark protection can last indefinitely as long as the mark is used in commerce and the required maintenance documents and fees are paid.
